Working from our Montreal head office, you will play a pivotal role in maintaining and shaping our future brands and trademark portfolio.

 

You are part of a unique Legal team involved in the strategic development, procurement, maintenance, exploitation, licensing and protection of our intellectual property rights. You will be counted on to act as a strategic and trusted advisor to internal client divisions and to intimately understand their business needs. You will be called to manage over 1400 active trademarks nationally and internationally.

 

Reporting to the Assistant General Counsel, Advertising and Brand, you will be a key collaborator with our Branding team and our external IP counsel.

 

What you will do:

  • Manage our internal trademark portfolio including registration, prosecution and renewal of trademarks domestically and internationally;
  • Conduct pre-screen (preliminary) searches in Canada, the U.S. and internationally on CIPO, USPTO and international trademark databases, as well as Internet searches, to find hits with proposed trademarks;
  • Provide registrability and availability opinions on proposed trademarks;
  • Prepare, submit and prosecute applications to the Canadian trademark registration authorities as the trademark agent of record;
  • Prepare and send demand letters and negotiate settlements;
  • Conduct trademark related due diligence in commercial transactional matters;
  • Liaise and assist with Canadian, U.S. and foreign counsel directly on the opposition and prosecution of Canadian, U.S. and international trademarks;
  • Support business units with respect to maintaining proper trademark use and notification.

 

Who You Are:

  • Registered Canadian Trademark Agent with CIPO (USPTO considered an asset);
  • Minimum 5 years of trademark experience;
  • Extensive knowledge of Canadian trademark law, including case law;
  • Knowledge of CIPO and USPTO trademark procedures and rules;
  • Experience in trademark application and prosecution;
  • Knowledge in trademark licensing;
  • Experience managing and maintaining a trademark docketing system and familiarity with docketing software;
  • Excellent time management and prioritization skills;
  • Ability to work independent and under pressure;
  • Detail-oriented with strong proofreading skills;
  • Excellent communication (oral and written) and human relation skills;
  • Bilingual (French and English, written and spoken).

Bilingualism is an asset (English and French); adequate knowledge of French is required for positions in Quebec.
